Subrogation Recovery:
Our claims handling experience is invaluable to our clients and
sometimes their friends or relatives. An
example occurred after an auto accident between our insured and another
driver insured by a direct
writer companies. My
insured’s wife had been struck by the other vehicle which turned into
her. The problem existed
because her vehicle was found to be a total loss, but the adjuster was
offering only $16,000 for a vehicle worth almost $20,000.
South Carolina requires the adjuster to explain why he offered less
than book value for the vehicle. We
helped resolve the problem by calling the adjuster and asking for an
explanation. and using the NADA book to determine the value of the
insured’s vehicle. Having experience as a claims adjuster allows us to know what
to ask for, what to say and how to negotiate a claim.
In another example, have you
heard the other carrier tell you to collect from your company and have
them subrogate to recovery the cost of repairs and your deductible.
If the companies are both members of inter-company arbitration this
can work, but you often have to wait months to collect your deductible;
and how about the rental car if you need one, but do not have rental
reimbursement coverage. Or in
another case, the other driver refused to report the claim to their
insurance carrier and after your carrier paid your collision claim minus
your deductible, they found that the damage of $1,500 was not worth hiring
an attorney to collect the damages.
